Abstract. Marriage dispensation is a request for ratification of the marriage that takes place, in which the prospective bride or one of the prospective brides has not reached the minimum age, namely the minimum limit as stipulated in Law Number 1 of 1974 concerning Marriage and Islamic Law. Based on the formulation of the problem and the purpose of the study, the approach method used is a normative juridical approach. This means that this research could include research on legal principles, legal systematics, the degree of legal synchronization, legal history, and legal comparison. Research location in the Cimahi Religious Court. The data used in this study consisted of primary data and secondary data. Data obtained from both the literature and the interview will be analyzed using qualitative analysis methods, a research procedure that produces descriptive analytical data. Thus the determination of the Religious Court regarding marriage dispensation is very important to carry out the process of legal rules for the continuity of child marriage under age. The conditions that must be fulfilled by the parties are to be issued a marriage dispensation letter by the court, namely a copy of the Birth Certificate in the name of the applicant's child that is released by the Village Head or Village and a Notice of Refusal to Carry Out Marriage issued by the Office of Religious Affairs. Factors that influence the judge's consideration to issue a marriage dispensation letter that is where the marriage is very urgent to take place and the applicant is considered capable of marrying even though he is not old enough so that the applicant is very worried that acts will be prohibited by the provisions of Islamic Law if not married immediately.Keywords: Marriage Dispensation, Religious Courts, and Marriage.Abstrak. Dispensasi nikah adalah permohonan pengesahan pernikahan yang dilangsungkan, di mana para calon mempelai atau salah satu calon mempelai belum mencapai batas usia minimal yaitu batas minimal sebagaimana yang telah ditetapkan dalam Undang-undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Hukum Islam. Berdasarkan perumusan masalah dan tujuan penelitian, maka metode pendekatan yang digunakan adalah pendekatan yuridis normatif. Berarti penelitian ini bisa mencakup penelitian terhadap azas-azas hukum, sistematika hukum, taraf sinkronisasi hukum, sejarah hukum, dan perbandingan hukum. Lokasi penelitian di Pengadilan Agama Cimahi. Data yang digunakan dalam penelitian ini terdiri dari data primer dan data sekunder. Data yang diperoleh baik dari kepustakaan maupun dari wawancara akan di analisis dengan menggunakan metode analisa kualitatif, suatu tata cara penelitian yang menghasilkan data deskriptif analitis.Dengan demikian penetapan dari Pengadilan Agama mengenai dispensasi nikah sangat penting untuk menjalankan proses aturan hukum demi kelangsungan pernikahan anak di bawah umur. Syarat-syarat yang harus dipenuhi oleh para pihak untuk diterbitkan surat dispensasi perkawinan oleh pengadilan yaitu foto copy Surat Kelahiran atas nama anak pemohon yang dikelurkan oleh Kepala Desa atau Kelurahan dan Surat Pemberitahuan Penolakan Melangsungkan Pernikahan yang di keluarkan oleh Kantor Urusan Agama. Faktor yang mempengaruhi pertimbangan hakim untuk menerbitkan surat dispensasi perkawinan yaitu dimana pernikahan tersebut sangat mendesak untuk dilangsungkan dan pemohon dianggap mampu untuk menikah walaupun belum cukup umur sehingga pemohon sangat khawatir akan terjadi perbuatan yang dilarang oleh ketentuan Hukum Islam apabila tidak segera dinikahkan.Kata Kunci : Dispensasi Nikah, Pengadilan Agama, dan Pernikahan. |
