Kebutuhan terhadap Sumber Daya air yang di butuhkan oleh apartemen The Maj atau perusahaan semakin meningkat oleh karena itu untuk memenuhi kebutuhan Sumber Daya Air oleh suatu perusahaan, maka perusahaan tersebut membentuk sumur artesis untuk memenuhi kebutuhan untuk di konsumsi oleh perusahaan tersebut. Seiring berjalannya waktu Apartemen The Maj yang masih dalam tahap proses akhir pembangunan mendapat protes keras dari warga sekitar apartemen, hal ini terjadi dikarenakan warga sekitar kehilangan air bersih mereka setelah di bangunnya Apartemen the Maj ini. Dilakukannya penelitian ini untuk mengetahui Penegakan Hukum yang dilakukan Pemerintah Kota Bandung terhadap pelaku usaha yang melanggar terhadap pengelolaan sumur artesis yang tidak benar. Penelitian ini menggunakan metode pendekatan yuridis normatif. Penelitian ini bersifat deskriptif analisis dengan berupaya menggambarkan, menguraikan dan memaparkan hal-hal yang berkaitan dengan permasalahan yang hendak di ungkapkan. Pengumpulan, mengelompokan dan mengkaji berbagai literature.Mencermati hal tersebut senantiasa menerbitkan kewajiban bagi negara untuk mengupayakan penyelesaiannya. Penyelesaian tersebut bukan hanya penting bagi pemulihan hak-hak korban, tetapi juga bagi tidak terulangnya pelanggaran serupa di masa depan. Jadi usaha penyelesaian pelanggaran Hak Asasi Manusia harus dilihat sebagai bagian dari langkah memajukan dan melindungi hak asasi manusia secara keseluruhan.Kata kunci : Artesis, Air Bersih, Hak Asasi Manusia, The Maj. |
