Abstract. Health is a healthy condition, both physically, mentally, spiritually and socially which allows everyone to live productively socially and economically. Health is one of the basic human needs. The case that occurred in Indonesia due to a lack of positive state actions to ensure that all citizens can enjoy the right to health, namely cases of malnutrition and measles that occurred in Asmat District, Papua Province, in September 2017 - January 28, 2018 which resulted in 71 deaths. The purpose of this research is to regulate the responsibility of the state in fulfilling the right to health in the International Covenant on Economic, Social and Cultural Right (ICESR) and the responsibility of the Indonesian government in fulfilling these rights in Asmat District. The approach method in this research is normative juridical. The research specifications used in this approach are Descriptive Analysis. The data in this research were obtained through library studies. The method of data analysis in this study is qualitative normative analysis. This study concluded that the State has the responsibility to carry out the general obligations of ICESCR in accordance with Articles 2, 3 and 4 and the obligation to fulfill the right to health in accordance with Article 12 paragraph (2). The Indonesian government is responsible for carrying out its obligations under ICESR.Keywords: Responsibility, Health, Right to Health, ICESCR.Abstrak. Kesehatan adalah keadaan sehat, baik secara fisik, mental, spiritual maupun sosial yang memungkinkan setiap orang untuk hidup produktif secara sosial dan ekonomis. Kesehatan adalah salah satu kebutuhan dasar manusia. Kasus yang terjadi di Indonesia karena kurangnya tindakan positif negara untuk memastikan bahwa semua warga negaranya dapat menikmati hak atas kesehatan yaitu kasus gizi buruk dan campak yang terjadi di Kabupaten Asmat, Provinsi Papua, pada bulan September 2017 – 28 Januari 2018 yang mengakibatkan 71 korban meninggal. Tujuan penelitian ini ialah untuk pengaturan terhadap tanggung jawab negara dalam pemenuhan hak atas kesehatan dalam International Covenant on Economic, Social and Cultural Right (ICESR) dan tanggung jawab pemerintah Indonesia dalam pemenuhan hak tersebut di Kabupaten Asmat. Metode pendekatan dalam penelitian ini adalah yuridis normatif. Spesifikasi penelitian yang digunakan dalam pendekatan ini adalah Deskriptif Analisis. Data dalam penelitian ini diperoleh melalui studi kepustakaan. Metode analisis data dalam penelitian ini adalah analisi normatif kualitatif. Penelitian ini disimpulkan bahwa Negara mempunyai tanggung jawab untuk melaksanakan kewajiban umum ICESCR sesuai dengan Pasal 2,3, dan 4 dan kewajiban pemenuhan hak atas kesehatan sesuai Pasal 12 ayat (2). Pemerintah Indonesia sudah bertanggung jawab untuk melaksakan kewajibannya berdasarkan ICESR.Kata Kunci: Tanggung jawab, Kesehatan, Hak Atas Kesehatan, ICESCR. |
