Abstract. The issue of the protection of Witnesses and Victims in the criminal justice process is one of the issues of concern to the international community. This can be seen by discussing the issue of protection for crime victims at the VII UN Congress of 1985 concerning "The Prevention of Crime and The Treatment of Offenders" in Milan, Italy, it is stated that "Victims right should be perceived as an integral aspect of the total criminal justice system. " (Victims' rights should be an integral part of the entire criminal justice system. The aim of this research is to determine the role of LPSK in protecting witnesses to victims of corruption from a human rights perspective. Knowing the form of legal protection for witnesses in cases of criminal corruption. This research is used in this research is the juridical normative approach. The data collection technique used by the author is literature study. The research specification used is descriptive analysis. The results of the author's research, the role of LPSK in protecting witnesses of corruption in a human rights perspective, has played an active role in protecting witnesses in cases of corruption. It can be seen from the graphic information above that in 2019 the LSPK has protected 115 witnesses of victims of corruption, as well as a form of legal protection for witnesses in cases of corruption. In its implementation, the form of legal protection provided by LSPK has not been able to provide maximum results.Abstrak. Masalah perlindungan Saksi dan Korban di dalam proses peradilan pidana merupakan salah satu permasalahan yang menjadi perhatian dunia internasional. Hal ini dapat dilihat dengan dibahasnya masalah perlindungan korban kejahatan dalam Kongres PBB VII tahun 1985 tentang “The Prevention of Crime and The Treatment of Offenders” di Milan, Italia disebutkan “Victims right should be perceived as an integral aspect of the total criminal justice system.” (Hak-hak Korban seharusnya menjadi bagian yang integral dari keseluruhan sistem peradilan pidana, Tujuan penulis melakukan penelitian ini yaitu untuk mengetahui peran LPSK dalam melindungi saksi korban korupsi dalam perspektif HAM. Serta Mengetahui bentuk perlindungan hukum bagi saksi dalam kasus tindak pidana korupsi. Metode pendekatan yang dilakukan dalam penelitian ini yaitu pendekatan Yuridis Normatif. Teknik pengumpulan data yang dilakukan oleh penulis adalah dengan studi kepustakaan. Spesifikasi penelitian yang digunakan adalah Deskriptif Analisis. Hasil Peneltian penulis, Peran LPSK dalam melindungi saksi tindak pidana korupsi dalam perspektif HAM, LSPK dalam hal ini telah berperan aktif melindungi saksi kasus tindak pidana korupsi. Dapat diketahui, dari info grafik diatas bahwa LSPK dalam tahun 2019 telah melindungi saksi korban tindak pidana korupsi sebanyak 115 Pelapor saksi tindak pidana korupsi. Serta bentuk perlindungan hukum bagi saksi dalam kasus tindak pidana korupsi. Dalam implementasinya bentuk perlindungan hukum yang diberikan oleh LSPK belum mampu memberikan hasil yang maksimal. |
