Abstract. The perpetrator has been indicted by the Public Prosecutor with an alternative indictment. But there are irregularities related to the issue of protection for victims of criminal acts of prostitution of minors. Which is where the victim is only a witness to explain the chronology of the case. Victims should have the right and obligation to be given protection and supervision so as not to cause a variety of psychological and physical problems for victims who are still under age. The purpose of this study is to determine the legal protection of child prostitution under Law Number 35 of 2014 concerning Child Protection and to find out whether victims have received legal protection or not in Court Decision Number: 1163/Pid.Sus/2018/PN.Bdg . The results use normative juridical methods using secondary data in the form of primary, secondary and tertiary legal materials. The results of the juridical analysis of the victims in the judge's decision No. 1163/Pid.Sus/2018/PN.Bdg regarding child protection cases have not reflected justice. Because the victim didn’t get the legal protection that should have been obtained in full during the trial.Keywords: Legal Protection of Child Prostitution Victims Abstrak. Pelaku telah didakwa oleh Penuntut Umum dengan dakwaan yang bersifat alternatif, Majelis akan membuktikan Pasal dakwaan Penuntut Umum tersebut yang dihubungkan dengan fakta-fakta yang diperoleh dan terungkap dipersidangan. Namun ada kejanggalan terkait permasalahan perlindungan terhadap korban dari tindak pidana prostitusi anak dibawah umur. Yang dimana korban hanya sebagai saksi untuk menjelaskan kronologis kasus tersebut. Seharusnya korban perlu mendapatkan hak dan kewajiban untuk diberikan perlindungan dan pengawasan agar tidak terjadinya berbagai masalah psikis maupun fisik terhadap korban yang masih dibawah umur tersebut. Tujuan dari penelitian ini untuk mengetahui perlindungan hukum terhadap tindak pidana prostitusi anak menurut Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan untuk mengetahui korban telah mendapatkan perlindungan hukum atau tidak dalam Putusan Pengadilan Nomor: 1163/Pid.Sus/2018/PN.Bdg. Penelitian ini mengunakan metode yuridis normatif dengan menggunakan data sekunder berupa bahan hukum primer, sekunder dan tersier. Hasil penelitian analisis yuridis terhadap korban dalam putusan hakim Nomor: 1163/Pid.Sus/2018/PN.Bdg mengenai kasus perlindungan anak belum menceminkan keadilan. Dikarenakan korban tidak mendapatkan perlindungan hukum yang seharusnya didapatkan secara lengkap semasa persidangan.Kata Kunci: Perlindungan Hukum Korban Prostitusi Anak |
